Virginia AI and Privacy Laws
Virginia has no broad AI law: a high-risk AI bill passed in 2025 was vetoed.
What the law says
In 2026 the state directed a study of independent verification organizations for AI, and its consumer privacy law gives residents the right to opt out of profiling used in decisions with legal or similarly significant effects.
What this means for your organization
The main obligations here come from the state’s consumer privacy law. If you use personal data for profiling or automated decisions, review your privacy notice, opt-out and appeal processes, and data protection assessments.
Our 2027 AI Governance Checklist covers the steps most organizations need, and our State AI Law Trackers explain the rules for specific industries.
